By accessing or using this website, you agree to be bound by these Terms & Conditions. By checking the "I agree to the Terms & Conditions" box at checkout, you acknowledge that you have read, understood, and expressly agree to be bound by all provisions of this agreement. You agree not to misuse this site, including attempting unauthorized access or scraping data. All content is the intellectual property of Southwest Michigan Sales L.L.C. and may not be reused without permission. Users must be 18 years or older to make purchases.
- Product Information
We strive for accuracy, but variations may occur due to lighting or screen settings. Product availability and pricing are subject to change without notice.
- Ordering & Payment
Orders are subject to acceptance and may be canceled at our discretion. Accepted payment methods include major credit cards and PayPal.
Payment Disputes and Chargebacks:
You agree to contact our support team to resolve billing issues before initiating a chargeback. A chargeback does not cancel your legal obligation to pay for goods received. If a chargeback is processed for a valid transaction, we reserve the right to:
- Engage third-party collection agencies (customer is responsible for all agency fees).
- Report unpaid balances to national credit reporting agencies.
- File fraud reports with local law enforcement, the U.S. Postal Inspection Service, UPS, or FedEx.
- Issue formal demand letters and recover reasonable attorney fees and court costs.
- Verification & Fraud Prevention
We reserve the right to verify customer identity or order legitimacy prior to shipment. Customer information may be securely shared with Wyllo (formerly NoFraud) for verification. Orders with indicators of fraud may be canceled at our sole discretion.
- Shipping Policy
Address Accuracy:
Customers are responsible for providing an accurate shipping address. Southwest Michigan Sales L.L.C. is not liable for misdeliveries resulting from incorrect information. If an order is returned due to an incorrect address, the customer is responsible for reshipment costs.
Packaging & Damaged Shipments:
We use new and recycled materials. If an item is damaged, notify us within 3 days. USPS claims must be filed at usps.com. UPS/FedEx claims require photos. If a carrier claim is denied, we will still refund your purchase.
- Returns & Refunds
Return Integrity:
Returned items must be the exact items originally shipped. We reserve the right to deny refunds for items that have been altered, substituted, or returned in a condition inconsistent with the original shipment.
Non-Returnable Items:
Certain items are non-returnable, including factory-sealed products that have been opened, digital goods, and products explicitly marked as “Final Sale.” These items cannot be returned unless they arrive damaged or are materially misdescribed.
- General Merchandise: 10-day return window.
- Electronics & Video Games: 3-day return window.
- Process: Refunds are issued within 5 business days of receiving the item in its original condition. Additional processing time for the refund to arrive to you may take an additional (5-14 business days).
- Condition Upon Delivery
All items are considered delivered in the condition described at the time of sale unless the customer reports damage or a discrepancy within 3 days of delivery. To report damage, the customer must provide supporting photos of the item, internal packaging, and external shipping box. Failure to report damage within this timeframe constitutes final acceptance of the item’s condition and a waiver of any future claims regarding arrival condition.
- Limitation of Liability
Our maximum liability shall not exceed the total amount paid by the customer for the specific order in question.
- Vintage Product Disclaimer
All vintage items are sold as collectible or second-hand goods. We cannot guarantee they meet modern safety standards (e.g., BPA or lead). Use for food, drink, or wear is at the buyer’s own risk.
- User Conduct
You agree to interact respectfully. We reserve the right to moderate or remove offensive user-generated content.
- Privacy Commitment
We comply with applicable laws regarding data protection. Please refer to our Privacy Policy for details.
- Governing Law
These Terms shall be governed by the laws of the State of Michigan.
- Dispute Resolution
Parties agree to first attempt informal resolution. Initiating a chargeback without attempting informal resolution constitutes a breach of these terms. Unresolved disputes shall be resolved exclusively in Michigan courts.
- Right to Refuse Service
We reserve the right to refuse service or cancel orders due to suspected fraud, abusive behavior, or policy violations.
- Force Majeure
Southwest Michigan Sales L.L.C. is not liable for delays caused by circumstances beyond our control, including natural disasters, pandemics, or carrier/transportation interruptions.
- Amendments & Severability
We may update these terms at any time. If any provision is found unenforceable, the remaining provisions shall continue in full force.
- Entire Agreement
These Terms, our Privacy Policy, and Return Policy constitute the entire agreement. No oral statements shall modify these Terms.
